
Terms & Conditions
These Terms and Conditions apply to all bookings made with JBFocal Films. By confirming a booking with JBFocal Films, you acknowledge that you have read, understood, and agreed to be bound by the following Terms and Conditions.
1. The following constitutes the Photography/Videography Agreement (the “Agreement”) of JBFocal Films (the “Photographer/Videographer”). Please read the Agreement in its entirety and contact the Photographer/Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the signer of this Agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records.
2. It is understood that JBFocal Films is the exclusive Photographer/Videographer retained by the client to cover outlined event. Any conflicts with other photography or videography coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.
3. Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for JBFocal Films each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client warrants that he/she has the legal rights to anything JBFocal Films will videotape, including photos, musical recordings, videotapes, or any other materials delivered to JBFocal Films for inclusion in the client's video.
4. JBFocal Films is not responsible for poor audio if the client does not agree to wear a lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client to allow camera-top lighting at the reception, or electrical or mechanical malfunctions on location that are beyond our control.
5. JBFocal Films will establish an arrival time for the wedding date with the client prior to that date and remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive.
6. JBFocal Films reserves the right to use videos and photos for display and or promotional purposes. All video masters, raw footage and photographs remain the exclusive property of JBFocal Films.
7. Artistic Style and Creative Control: On their own behalf and on behalf of all subjects, the Client acknowledges that they are familiar with the JBFocal Films portfolio and are commissioning services with full knowledge of the company’s established and evolving artistic style. The Client understands and agrees that JBFocal Films’ work is of a unique and artistic nature and that the final delivered content may differ from previous work displayed in the portfolio.
8. JBFocal Films retains full creative and editorial discretion in the production, editing, and final presentation of all photo and video content. Creative decisions will be made in accordance with our professional judgement and artistic vision of the event, which may differ from the Client’s or any subject’s personal preferences or expectations. Accordingly, the Client agrees that delivered content shall not be subject to rejection, revision, or refund on the basis of taste, style, aesthetic preference, or subjective interpretation.
9. Music Selection Requirements: The Client acknowledges that the completion of video deliverables is dependent upon the timely provision of suitable music selections. Music requirements are defined as follows:
- Teaser video: Music selection is optional. Where the Client elects to include music, one song is required.
- Highlight reel: Music selection is mandatory. A minimum of five songs must be provided.
- Feature film: Music selection is mandatory. A minimum of twenty songs must be provided.
JBFocal Films shall not be responsible for any delay in delivery where music selections are not provided in accordance with the above requirements. Delivery timelines will commence or resume only once all required music has been chosen.
10. Team Coverage and Package Scope: The Client understands that all photo and video packages are designed and priced on the basis of a minimum of two professional operators, unless explicitly agreed otherwise in writing. Coverage, angles, and captured moments are therefore dependent on realistic logistical and operational constraints on the day.
11. Stills from Video Disclaimer: Where a video package includes still frames or video-derived images, the Client acknowledges that these are supplementary in nature and are not intended to replace professional photography. Video stills are extracted from motion footage and will differ in resolution, dynamic range, and overall quality when compared to photographs captured as part of a dedicated photography package. Video stills shall not be used as a substitute for contracted photographic coverage, nor shall they be judged against the standards of standalone photography services.
Any video stills provided are supplied at no additional cost as a complimentary bonus inclusion within the video package. Their provision does not constitute a photography service, nor does it create any obligation for JBFocal Films to deliver photographic coverage beyond the scope of the agreed package.
12. If JBFocal Films fails to comply with the terms of this agreement due to any event or at beyond the control of JBFocal Films, including but not limited to illness, accident, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, JBFocal Films liability is limited only to a refund of all monies received.
13. The client reserves the right to terminate the contract for any reason up to 5 days before the day of the wedding. Should the client terminate the contract, all money paid minus the retainer which is 10% of total cost, will be refunded.
14. JBFocal Films shall deliver the completed wedding package within 3 months, defined as 12 full weeks, from the date of the wedding. This timeframe reflects our standard and expected delivery period.
In the unlikely event of exceptional circumstances beyond our reasonable control, including but not limited to equipment failure, serious illness or injury, bereavement, acts of God, or other unforeseen operational or technical issues, JBFocal Films reserves the right to extend the delivery period to a maximum of 6 months from the wedding date. This extended timeframe represents a worst-case contingency only and is not indicative of normal delivery practice.
Should such circumstances arise, the client will be notified as soon as reasonably practicable and kept informed of any revised delivery expectations.
